Types of Bail Bonds in Austin, TX

After a judge establishes the amount of bail there are four ways to gain release from jail: cash bond, personal bond, lawyer assisted bond and surety bond.

Cash Bail Bond

This calls for someone to post the full amount of the bail set by the judge. Despite the name of this bond, the Travis County Jail does not accept cash for bail. A cashier’s check or money order must be presented at the jail.

Note that bail could be set in the thousands of dollars, making it difficult for many to come up with that amount of money. In addition, the funds cannot be retrieved until after the criminal case is resolved. That means the money could be tied up for years.

Personal Bond

Following an arrest in Austin, the Travis County Pre-Trial Services Office will interview the defendant to determine if a personal bond is an option for jail release. If they qualify, the person in jail only needs to pay a $20 personal recognizance bond. While this is a very affordable route, it can be time consuming and is not always approved. In addition to waiting for a judge to set bail, the Pre-Trial Services Office can require up to another 12 hours to determine if the arrestee qualifies for a personal bond. Waiting for a case to be reviewed by the Pre-Trial Services Office does not mean a personal bond option will be approved. In many cases, hiring legal counsel is required before a personal bond is approved.

Surety or Bail Bonds

Depending on the details of the criminal arrest, it may be necessary to go to a bail bond company. A bail bondsman typically charges 15-20% of the bail amount to basically guarantee that the jail will be paid. Note that the fees paid to a bail bondsman cannot be applied to a lawyer’s fees.
